DELIVERABLES: This is will be a 1 hour photo shoot, and includes 70 edited digital files. Edited images will be sent out via an online gallery 7-10 days after the session. Prints & products are available to be ordered online through your gallery for an additional fee, but are not required. AGREE

ADP POLICIES:ADP holds all artistic license to these photos – that means that the composition, cropping, focus, & any editing done to the files is at the sole discretion of ADP. Please make sure you are familiar with ADP’s style of shooting & editing, as all photos are consistent with that style. ADP will not edit outside of their regular parameters without an additional fee.Client will not edit, filter, crop, or in any way alter the images received from ADP. This includes adding filters from Instagram, Facebook, etc.RAW files will not be released to clients under any circumstance.Client will tag Ashley DeHart Photography in all social media posts featuring the photos.

PAYMENT & FEES: Upon your signature, ADP will reserve the date and time agreed upon, and will not make any other reservations for that date and time. For this reason, the retainer reservation is non-refundable. The reservation retainer is applied towards the contracted photography package. After completion of the photography session, no refunds of any kind will be given. The session time starts as soon as ADP shows up to the location at the agreed upon time. If the client is late, the shoot time will not be extended. If the client is more than 15 minutes late to a shoot, the shoot will be cancelled and will need to be rescheduled for an additional fee of $75.00. • Additional fees: Clients are responsible for paying for all permits, entrance fees, etc at all locations. Travel fees will apply to any session more than 30 miles from Bountiful, UT. See “Schedule A: Travel Fees” for information about travel fees.AGREE

RESCHEDULING: If Clients needs to reschedule their session, they must notify ADP at least 2 weeks in advance of their scheduled date. If Clients need to reschedule with less than two weeks remaining until the shoot time, then there will be a $75.00 fee to reschedule your session. The session will only be rescheduled one (1) time as a courtesy. Multiple rescheduled dates will incur the $75.00 reschedule fee. If the session needs to be rescheduled due to inclement weather, that will be determined by the photographer, with input from the client. If a session needs to be rescheduled due to inclement weather, there will be no rescheduling fee required. Acceptable Weather Conditions: slight rain, slight snow, wind under 15mph, overcast, sunny, etc. Unacceptable Weather Conditions: heavy rain, blizzard/whiteout snow storm, & wind over 15mph.AGREE

COPYRIGHT & PRINT RELEASE: The images that are being provided to Clients are licensed to Clients for any reasonable personal purpose, including but not limited to: printing, copying, emailing, and web publishing. Clients are hereby granted permission by ADP to reproduce the images and make an unlimited number of prints, for personal use only. Bearer agrees that they may not use any ADP images for commercial or editorial purposes, or enter ADP images into competition without express written consent. Your license does not include use that results in financial gain including, but not limited to: advertising, stock photography, print sale profits, or resale of any nature. ADP retains the copyright to all images, per USC Title 17 (US Copyright Law). Clients purchase of the edited files releases ADP from any liability due to loss or damage of the images once delivered, and also releases ADP from any obligation to maintain copies of any digital file, image, or photograph after 6 months. You hereby grant ADP the right to use and publish images and photographs taken at your wedding to further promote its service, including: portfolio, website, display, advertisements, and editorial use. ADP agrees to limit the use of these images and photographs to promotional use only. ADP offers professional products to display Clients photos in the best way possible. Client’s package comes with a personal print release, however, ADP cannot guarantee the quality of any prints made using an outside printer. AGREE

EMERGENCY SITUATION: In the case of a medical emergency where Ashley DeHart Photography is not able to attend a session, it will be rescheduled within a week of the original date and/or for a time that best fits the photographer & client’s schedulesAGREE

GOVERNING LAW: The validity, construction, and enforceability of this Agreement shall be governed in all respects by the laws of the State of Utah. If any dispute arises in connection with or relating to this Agreement, then the Parties agree that the proper jurisdiction shall be the courts located in Davis County, Utah and the Parties waive any defense of personal jurisdiction or lack of venue.AGREE

DISPUTE RESOLUTION: Any claims arising out of this Agreement shall be first submitted to a licensed neutral party in a mutually agreed upon location and on a mutually agreed upon date to make a good faith effort to resolve or settle the issue by mediation. In the event that the Parties do not successfully reach an agreement, all claims or disputes in excess of the jurisdiction of small claims court shall be submitted to binding arbitration. The Parties shall select a single arbitrator, and the arbitration shall take place in Davis County, Utah. The arbitrator’s decision shall be binding on the Parties and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. The prevailing Party in any arbitration, trial or other proceeding shall be awarded all filing fees, related administrative costs.AGREE

I have read and understood the above terms, and agree to pay 100% up front to reserve my session date. I understand this payment will NOT be refunded in the event of a contract cancellation. I understand that this contract can be cancelled at any time by ADP if payment is not made on the appropriate dates. Payment will be accepted in the form of Cash, Check, PayPal, or Square.AGREE
